    Law Enforcement Perspectives on Cyberbullying

    Much of our work to teach adults about what teens are doing online is directed toward educators or parents, but increasingly we are working with law enforcement officers – especially those assigned to a school setting (school resource or liaison officers). Like the others, police officers often find themselves in a difficult situation when confronted with a cyberbullying incident because of unfamiliarity with the technology or ambiguity in currently laws not designed to address such behaviors. Despite deficiencies in the law, most officers recognize that their role goes beyond simply enforcement. This is especially true for school-based officers who are mentors, educators, investigators, first responders, and so much more. Even when it comes to responding to cyberbullying or other teen technology misuse, law enforcement officers should be encouraged to use their discretion to “handle” the particular situation in an informal and creative way, when appropriate. Threats of arrest or detention don’t usually deter students from misbehaving, because they often feel invincible or able to elude the law. But the student who develops a strong bond to an officer will no doubt follow the law voluntarily in order to avoid disappointing their mentor. This is related to the broader issue of the importance of developing a caring and respectful climate at school—one in which the school law enforcement officer is a contributing part.

     

    Over the last couple of years, we have formally surveyed approximately 1,000 law enforcement officers (including over 300 school resource officers) to better understand their unique perspectives concerning cyberbullying and other online behavioral problems. I will be presenting some of this research at the annual meeting of the Midwestern Criminal Justice Association later this week in Chicago. In general, over 85% of the officers surveyed said that cyberbullying was a serious concern that warrants the response of law enforcement. Almost 90% of the school resource officers had dealt with a cyberbullying case “sometimes” or “often.” Interestingly, though, about 25% of the school resource officers and over 40% of the traditional law enforcement officers didn’t know if their state had a law specific to cyberbullying.     So what we have learned in our preliminary research and discussions with law enforcement officers is that they realize they have a role to play, but they need more training. More and more states are passing laws on bullying and cyberbullying and while most of the legislation focuses on the responsibilities of educators, many school administrators are turning to their law enforcement partner for assistance. If you are a school-based officer, then you are in the right place to learn about these issues. If you are an educator or parent, you might want to pass our site on to them so they have a resource to turn to.

     

    If we want to stop cyberbullying, all of the adults who interact with students need to recognize it as something worth stopping. That means we should talk with adolescents about online responsibility and integrity and intervene when we see or hear something inappropriate. Again, that doesn’t mean we should arrest and formally sanction those who engage in bullying. We have long argued that most cyberbullying cases should be handled informally. I believe that law enforcement officers should be in on these efforts as well. We need to remember that the primary goal is to get the bullying, no matter where it is happening, to stop. The more we accept that as our underlying mission, the easier it will become to see what needs to be done.

    Resources to Teach Your Students about Cyberbullying and Online Responsibility

    Now is the time to start thinking about what *you* are going to do to educate your students about cyberbullying, digital citizenship, online responsibility, and overall safety. A key to any educational effort is consistent reinforcement of the messages you want students to incorporate into their daily lives. Convening an all-school assembly on these topics once each schoolyear is not sufficient. But bringing up online issues even for just a few minutes regularly (daily!) can be very effective. No matter what your area of teaching expertise is, you can talk about digital citizenship. When it comes to educating your students about online issues, there is no need to reinvent the wheel. There are tons of great resources freely available on the web. You already know about our site, but in case you haven’t explored it fully, below are just a couple of examples of activities you can incorporate into your classes.

     

    Cyberbullying Word Find. You can start a discussion about cyberbullying with a fun activity that introduces important terms and concepts to your students. After all of the words are found you can talk about what they mean and how to avoid problems. Or you could separate the word list from the sheet and announce them one at a time and briefly discuss them as they are found! One school we talked to laminated our Word Find (and our Crossword Puzzle and Word Scramble) and used them over and over in different upper elementary classes and the class that solved them the quickest one a pizza party!

     

    Quizzes. We have three short online quizzes that you can use to assess your student’s knowledge about cyberbullying: The Facts about Cyberbullying; Dealing with Cyberbullying; and Addressing Cyberbullying. You can work through these in a computer lab or if personal devices are allowed in your school, you can direct your students to the site to complete the quizzes on their phone, tablet, or laptop. If those aren’t options, you can always print off the quiz and distribute it the old fashioned way! You can have students work in teams and give extra credit for those who get them all correct. After they are done with our quizzes, have each student (or team of students) search reputable sites online to come up with their own questions and answers!

     

    Ideas to Get Teens Involved. In our presentations we talk a lot about how it takes a coordinated and comprehensive community effort to prevent and respond to cyberbullying. Parents, educators, law enforcement officers, faith leaders, and other community partners all have an essential role to play. But so do the teens themselves. There are a lot of great things youth can do to educate their community about cyberbullying – while learning a thing or two themselves. When working with small groups of teens I often ask teams of 4 or 5 students to come up with 2 creative ideas that they could do to educate their school and community about cyberbullying. One idea needs to be something that they *will do* within the next month and the other idea can be something that they would do if resources were unlimited. They always come up with some amazing ideas! One senior once told me that if money were no option he would get the whole school to go skydiving over the community with parachutes that said “Say No to Cyberbullying” on them. Great idea! What ideas do your students have? Get them involved and invested in creating and maintaining a bully-free culture in your school.

     

    Pause Before You Post. Sameer and I partnered with Jostens to create “A Student’s Guide to Personal Publishing” that summarizes the issues that students need to keep in mind when posting information to the World Wide Web. You can use this guide to start a discussion with your students about some of the problems they see when looking at friends’ profiles. You can also take a few minutes to find some examples from the media where teens from your state or celebrities have gotten into some hot water because of what they have posted on the Internet. Taking the time to pause before you post anything online is always wise. If your school orders class rings or yearbooks from Jostens, ask your local representative about a complete “Pause Package” that includes a DVD, buttons, and other instructional materials.

     

    These are just a few examples of how you can use our resources in your efforts to educate your students or children about cyberbullying and related issues.     Cyberbullying and School Climate

    There has been a lot of talk about improving school climate recently, in line with the U. S. Department of Education’s new focus for public schools across the nation (and their Safe and Supportive Schools initiative). I have recently discussed it in January at a NCPC summit, and covered it briefly two weeks ago while at the Bullying Summit in DC, but I’d like to expand on it for our readers. As a starting point, though, I need to provide a foundational backdrop. We’ll explore climate and cyberbullying in great detail over the upcoming months.

     

    To begin, Welsh, Greene, and Jenkins (1999) have defined school climate as “the unwritten beliefs, values, and attitudes that become the style of interaction between students, teachers, and administrators…[it] sets the parameters of acceptable behavior among all school actors, and it assigns individual and institutional responsibility for school safety.” While that is a bit academic and wordy, I feel that it conveys what is meant. Basically, we are talking about the quality of life for students and staff on campus.

     

    The benefits of a positive school climate have been identified through much research over the last thirty years. It contributes to attendance, student achievement, and other desirable student outcomes. Improving climate on school grounds has also been linked to improvements in student behavior – such as a decreased peer-on-peer bullying and an increase in perceived and actual safety.

     

    In a recent study we conducted, students who experienced cyberbullying (both those who were victims and those who admitted to cyberbullying others) perceived a poorer climate or culture at their school than those who had not experienced cyberbullying. Youth were asked a variety of questions, such as if they “enjoy going to school,” “feel safe at school,” “feel that teachers at their school really try to help them succeed,” and “feel that teachers at their school care about them.” Those who admitted to cyberbullying others or who were the target of cyberbullying were less likely to agree with those statements.

     

    We are continuing to explore this relationship, and believe strongly in efforts to enhance climate in schools across the nation. There are very practical ways to do this, and we’ll discuss them in forthcoming blog entries.

    Patterson v. Hudson Overturned

    Back in March I wrote about this case, where a federal jury had ordered the Hudson Area School District in Michigan to pay $800,000 in damages to a student who was repeatedly harassed by classmates (and allegedly staff) for a period of several years.  A federal district court had been reviewing the facts of the case and recently overturned the jury’s order, stating that the harassment the student experienced was not sexual in nature and therefore not subject to a Title IX claim.  This despite being called a “queer” and “faggot” on a regular basis and his locker being “covered with shaving cream spelling out sexually oriented words.”  The court also asserted that the plaintiff failed to prove that the school was deliberately indifferent to the harassment that had been taking place.

    There are a couple of important lessons that can be learned from this case.  First, holding incompetent school officials accountable for their actions, or lack thereof, can be very difficult.  To be fair, we were not present during the hearings and do not have access to all of the evidence presented.  From court records, however, it seemed clear to me that school officials were ignorant at best and most likely indifferent.  Obviously Federal Circuit Judge Lawrence Zatkoff didn’t agree with me.  Please read the facts of the case here and assess for yourself.

    Second, it is important that students who are bullied keep very detailed records about what happened, what they did in response, who they told, and what that person did to fix the problem.  Targets of bullying also may need to fully exhaust all school-level mechanisms for responding to the bullying.  They need to give the school a chance to make things right.  School officials too need to keep very good records pertaining to bullying incidents so that they can articulate the steps that were taken to demonstrate, as apparently the Hudson Area School District did, that they took appropriate actions to remedy the problem.

    School officials cannot become complacent and assume that there is zero liability if they ignore bullying that affects their learning environment and interferes with the rights of students to feel safe at school. Our colleague Nancy Willard pointed us to a couple of examples: In Vance v. Spencer County Public School District (2000), a jury ordered the school to pay the target of student-on-student sexual harassment $220,000.  In a similar case (Theno v. Tonganoxi Unified School District, 2005), another jury ordered the school district to pay the target $250,000 for being deliberately indifferent to, once again, student-on-student sexual harassment occurring at school.  Both of these cases involved sexual harassment that occurred at school and both involved jury orders.  Common citizens could clearly see that the schools in these cases were irresponsible, indifferent, and should have done more to protect students.  Interestingly, the facts of the Theno case are very similar to the Patterson case, especially with respect to the names that the target was being called.

    If we have learned anything from all of these cases, it is that this is a legal area that is far from clear.  What do you think?  Were staff members at the Hudson Area School District indifferent to the harassment?

    Humor Limits and Cyberbullying

    I have recently been chatting with Dr. Linda Young – whose work I greatly respect – about the topic of “humor limits.” In our trainings to youth-serving professionals, Justin and I discuss how teaching adolescents when comments made cross over a line and no longer are “funny” but are “abusive” and harmful. For example, the term “food baby” is currently used among teenagers to reference their slightly enlarged or bloated stomach after eating way too much. This is generally funny when a person points out their own food baby to others, but can cross a line and be intepreted as mean-spirited, embarrassing, or otherwise rude when a person points it out in someone else who may be self-conscious about their weight.

     

    Additionally, many things are described by youth as “retarded” or “gay” – a practice which we do not condone in the slightest. While we wish that adolescents would not use these terms at all, those who do should be very careful as it may offend one or more persons in their social audience. Those words can easily exceed a standard of acceptability in conversations, and be perceived as prejudicial, hateful, and harassing.

     

    Due to the anonymity, pseudonymity, and freedom that online communication allows as compared to face-to-face interactions, humor limits are easily crossed – and many statements made on Facebook walls and comment threads in an attempt to be sarcastic or humorous end up inflicting harm. This can at times be considered cyberbullying, and often leads to hurt feelings and broken friendships. We would do well to share various examples of this phenomenon with kids – and discuss them in detail – so that they more readily think about their audience and how their words might be interpreted before posting or sending potentially inflammatory content.
